Competency 310.1.5: Labor and Employment Law
Situation A
Under the FMLA, the employee requesting leave from the company does fall under the employee eligibility act as he met the 12 month and 1,250 hour requirements and has been with the company for two years. The Employee was out for 11 weeks with unpaid leave, which is within the 12 week time frame permitted under FMLA. Under the entitlement to leave, he qualifies because he was also caring for his newborn twins who have health conditions due to the fact that they were born pre-mature. Upon returning the company he was given back his position with the original pay and benefits by his new manager, which is with-in the requirements of job restoration under FMLA. A violation has not occurred in regards to this employees claim by the denial of 11 weeks withheld salary as FMLA regulations state that up to 12 weeks maybe taken either straight through the rolling year or intermediately, but it is unpaid. Therefore he has no claim of any violation under the Act by the managers’ denial.
Situation B
“Under the ADEA, it is unlawful to discriminate against a person because of his/her age with respect to any term, condition, or privilege of employment, including hiring, firing, promotion, layoff, compensation, benefits, job assignments, and training.” The ADEA protects employees who are forty years old and older. I would say the company violated the ADEA by denying the 68 year old employee a promotion based on his age and also because they could not provide any reasoning as to why they didn’t promote him. Especially after he was given an exceptional review and the promotion went to an employee with an average review. Due to this violation, the employee has a right to file a claim against the company.

Situation C
“The ADA prohibits discrimination based on disability in employment, State and local government, public…...

...truth was, the factors to consider when choosing an online university were many and overwhelming, and I was afraid to start. I finally launched into research mode and began searching in earnest for “the perfect fit.” After much courting and wooing by several universities offering online programs, three major factors influenced my decision to become a Western Governors University (WGU) student. These are an excellent online support system, a unique competence based approach to learning, and affordability. I urge you to carefully consider these factors; you too will be convinced that WGU is the choice to make. WGU offers an excellent and unique support system to students. The availability of online education promises the ease and flexibility of independent learning. Why Wgu

...one of the best choices in today’s educational market. One of the first considerations for any student, and especially for an adult student with many responsibilities, is that of finances. Is the school affordable? Will getting an education be worth the money spent, or will the student be left so far in debt when the education is complete that stress and worry over repayment of loans outweigh the benefits of the education received? By choosing Western Governors University, one can eliminate that stress. Because WGU is an online only school, many of the traditional expenses, such as buildings and maintenance, don’t play a role in determining the cost; this is one factor that helps keep tuition fees low. Another reason the tuition is so affordable at WGU is because Western Governors University is a not-for-profit school. The tuition charged is for the sole purpose of educating the students, and is not used to line investors’ pockets; therefore, the cost to attend WGU, ranging from $2,890 to $4,250 per term depending on the course of study, is far less than what is charged by other schools. ...(Barclay, 2001) ]. The 1840's was a defining moment in American growth and history. Not only was gold discovered in California, but America had also just procured what we now call the state of California from the Mexico. With this came great enthusiasm and interest from the rest of the U.S., and with the gold rush as a cherry on top, many embarked on a journey that would lead them to California, not only to quench their curiosity, but to also benefit from its rich gold deposits and rich fertile soil [ (Barclay, 2001) ]. This undoubtedly large immigration of people gave rise to settlements across our great Northwestern plains, thus, giving rise to the great expansion of our great nation, the United States of America. In researching this paper, I found that the most significant thing in the expansion of great societies is their need for natural resources and the environment from which they thrive. It is clear to me that resources from the environment in which people inhabit can make a great impact on how much that society with succeed. As shown throughout history, rivers play an immense role in both the cultivation of resources, as well as the prosperity of life, whether it was the ancient Egyptians, Native American Indians, or modern day America. ...of 4M or do we need to implement another metric system that will be better suited to accommodate the company in the direction that we are going? Once trust has been built throughout the organization then environmental considerations can be considered such as encouraging employees to work together inside and outside of the work place. As a recommendation a recycling program will be implemented that encourages employees to recycle at their homes and also to bring their lunches and reuse or recycle their containers. Also, employees will be encouraged to purchase recycled supplies and recycle used supplies to the original manufacturer. 4M will participate in Reduction of paper products while producing written records and/or elimination of wasting paper products by utilizing various ways of written communication such as email or other electronic sources. The Carpooling Program will encourage workers to carpool with other employees to save on gas and to eliminate pollution. As these requirements of performance measurement is met and the ethical leader develops a plan to execute this recommendations an employee environmental incentive program should be put in place to further encourage employees to become more environmentally friendly. As an Ethical leader, the goal is to the change the culture and environment of a corporation by changing the outlook of its employees through trust and motivation. Sustainability......

Mushroom poisoning is a relatively rare cause of acute liver failure (ALF). The present paper analyzes the pathogenesis, clinical features, prognostic indicators, and therapeutic strategies of ALF secondary to ingestion of Amanita phalloides, which represents the most common and deadly cause of mushroom poisoning. Liver damage from Amanita phalloides is related to the amanitins, powerful toxins that inhibit RNA polymerase II resulting in a deficient protein synthesis and cell necrosis. After an asymptomatic lag phase, the clinical picture is characterized by gastrointestinal symptoms, followed by the liver and kidney involvement. Amatoxin poisoning may progress into ALF and eventually death if liver transplantation is not performed. The mortality rate after Amanita phalloides poisoning ranges from 10 to 20%. The......

...GKE1 Task 3 Part A. The rise of New Imperialism in Africa began in 1881 and ran through 1914. Looking to expand their empires, European countries looked to Africa as its size and benefits became evident. The invasion of Africa began as a paper conquest, conducted in the drawing rooms of European capitals. Once they arrived in Africa, leaders and footmen took the ideas from Europe and put them into action on the ground. They conquered weak African chiefs and signed treaties with the powerful ones. Soon after arriving, treaties were thrown aside and the conquest began. Having far more resources and a technical advantage, European countries rolled through to central Africa. The strong firepower of the Europeans crushed most if not all of the African resistance. The Berlin Conference of 1884-1885 was the highlight of European competition for territory in Africa. France, Germany, Great Britain, Italy, Portugal, Spain, and King Leopold II of Belgium together had acquired thirty new African colonies. They came together to negotiate their claims to African territory. They were then formalized and divided into forty new political units, subsequently displacing 110 million Africans. These units were drawn as straight lines with no regards for the villages, ethnic groups and African kingdoms. (scramble for Africa, 2015) Part A1 The indigenous people of Africa originally trusted Europeans. They believed the treaties they signed were merely a formality and based upon......

Professional Roles Nursing Wgu

...Professional roles Lori Wilson WGU Differences between a regulatory agency and a professional nursing organization Regulatory bodies regulate professionals in the public interest while organizations advocate on behalf of members for professional and public policy matters. The government has mandated regulatory bodies for health professionals to handle professionals in the interest of the public. The body protects the public by gearing the professionals to provide safe, ethical and competent care. Some duties of regulatory bodies include registration, standards of professional ethics, continuing competence/quality assurance, inquiry, discipline and standards of professional ethics. Individual restraints direct most authorities. The mission of nursing regulatory bodies is to protect the public through regulating registered nurses, supporting nurses to meet set standards, setting standards and taking appropriate action when the given standards are not met. These bodies support nurses to meet their standards by offering resources such as education about standards, provision of libraries, and practice consultation (Hamric, et.el. 2013). The government has allowed members of an organization to determine the mandate of their organizations that serves their purposes. Organizations are majorly focused on advancing awareness of the professional contributions that can ensure better policy planning and health care pursuit. Nursing organizations......

These roadblocks may include things like brand recognition, disposable income, sales on their stock, advertising and the capability to help other stores that maybe facing poor sales. Being a smaller company they may operate with a different code of ethics and have different areas of emphasis. A large chain store may have the capability to absorb losses that resulted from theft, etc. but a smaller chain store may not be capable of doing so. Company Q has had to close down a couple of stores due to these stores not being able make a profit. With this closure they have had to redirect there priorities. At the end of the day it is about money and Company Q is not a non-profit organization so they have to be primarily accountable to their financial statements to survive. With the food bank asking if Company Q would donate some day old organic foods, Company Q had to make a choice. The socially responsible choice would be to donate food to help out the people within the neighborhood, however Company Q has legit concerns in regards to the possibility of employees stealing the donated food and taking it home instead of donating it to the local food bank. Company Q made the choice to dispose of the food instead of dealing with the possibility of theft from their employees. I think Company...

...Organizational systems and Quality leadership. C489-Task 2-revised version Gina Potter 000203903 Western Governor’s University January 31, 2016, 2016 The goal of this paper is to scrutinize the regrettable sentinel event of Mr. B, a sixty-seven-year-old patient who was admitted to a rural ED with left leg pain that he found unbearable. A root cause analysis will be used to exam the causative factors that led to this unfortunate sentinel event. Then I will identify the errors or hazards in the care of Mr. B. A change theory will then be utilized to establish a useful improvement plan that would hopefully decrease the chances of a repeat of the outcome in the Mr. B scenario.  A Failure Modes and Effects Analysis (FMEA) will then be used to project the likelihood that the suggested improvement plan would not fail.  In conclusion key roles of the nurses involved in the care in the Mr. B scenario will be discussed. I have completed the RCA considering: causative factors, errors and hazards that had unfortunately lead to the death of the 67 year old patient that was brought to the ED. By performing the RCA we start at the beginning with the causative factors, we list staffing levels, who was there and who was not. The participants during the root cause analysis would be the emergency room physician (Dr. T.), the LPN and RN (Nurse J) the respiratory therapist who was in house but not in the ED at the time of this sentinel event, and the unit secretary. The nursing profession encompasses regulatory agencies, professional organizations, theories, values, traits and a code. The following outlines some of what it means to be a nurse. A. Functional Differences The Board of Registered Nurses is an entity set up to protect the public from nurses and to regulate the practice of registered nurses. It protects the public by: setting educational standards for RN’s, approving nursing programs, evaluating license applications, issuing and renewing licenses, issuing certificates, taking disciplinary action when needed and managing intervention programs. Wgu- Professional Presence and Influence

...Professional Presence and Influence C351 WGU Sarah Belmont Healthcare, and Medicine is advancing more and more each day. As healthcare workers, our understanding of health and healing has improved and changed in the way we care for our patients. Dossey believed in the three eras of medicine. Era 1 began in the 1800s and its focus was solely on the body. The belief that healing and overall health are totally physical. The therapies and treatment were either medications or surgical procedures. The thought that healing all humans based on bodily functions, and how they can be treated will change as time changes. Era 2 began in the 1950s and it focused on the mind and body. Health care providers realized that feelings, emotions, and attitudes impacted health. The mind is boundless and it affects a human’s body. (Dossey, n.d) The mind can play tricks and be your own worst enemy if not properly addressed and treated. Although, the world continues to evolve with healthcare and the approach in which we care for patients, there is still much to learn. Mind and body is similar in my professional presence with regards to using your mind to analyze and be aware of each patient’s similarities and differences. Having a positive attitude and mind will help make better choices for your health and well-being. I have adapted a more positive outlook and added prayer to my personal life.
